This petition is pending since last two years. In spite of that no reply has been filed by the respondents. By order dated 23rd October 2013, the respondents were directed to file reply on or before 26th November 2013. However, no reply has been filed.

The petitioner is claiming pensionary benefits considering Fifth Pay Commission's recommendations. The petitioner is entitled to make comprehensive representation to the Solapur Municipal Corporation in respect of his grievances. Learned counsel for the petitioner submits that petitioner had earlier filed representation dated 8th November 2012

addressed to the Commissioner of the Corporation but, according to learned counsel, no decision was taken on the same.

Without expressing any opinion on merits of the matter, we direct that in case the petitioner files a comprehensive representation in respect of subject matter of the petition addressed to the Commissioner of the Corporation within three weeks from today, then the Commissioner/ Corporation shall take appropriate decision on its own merits within two months from the date of receipt of the representation and communicate the same to the petitioner.
