30/12/2011 from the projected affected category. The grievance of the petitioner is that in spite of the selection, the petitioner was not given appointment order as there was no vacancy in Solapur Education Office.

The learned counsel for the Zilla Parishad submits that in case

vacancy arises the respondent No. 6 would consider the petitioner for appointment. We find an affidavit-in-reply filed by Shri Shri Vasant Bapusaheb Paymal, the Commissioner, Maharashtra State Council of Examination. In para 3 the deponent states as under:

“3. I say that in accordance with the priorities given by the Petitioner, the Petitioner was recommended for appointment to the Prathamik Shikshan Mandal, Solapur Municipal Corporation for appointment as Shikshan Sevak. The petitioner wanted appointment in the category of partial service. At the time of interview, he did not produce the requisite certificates for being eligible to the said category.”

4 Without expressing any opinion on the claim of the petitioner, we direct that the respondents shall examine in detail the case of the petitioner and take appropriate decision.
