Heard learned Counsel for the parties. Perused the record.

We may refer to order passed by this Court while disposing of three writ petitions No. 9359/12, 6243/13, 8261/12 in respect of the amendment brought to the provisions of Maharashtra Cooperative Societies Act.

The learned Counsel appearing for petitioner submits that these two petitions which were circulated yesterday relate to challenge the communications made by authorities regarding transfer of Gat Sacheev/Group Secretaries of the Society.

The learned Senior Counsel appearing for respondent-State submits that in view of disposal of three petitions stated above relating to the basic question of deletion of provisions of Section 69 A from the Co-operative Societies Act, the challenge raised to the impugned communication in these petitions does not survive.

¶16

We have perused the record placed before us including the impugned communications. In view of the orders passed by this Court yesterday in the petitions stated above, we clarify that the petitioner will be entitled to raise appropriate challenge as and when the cause of action arises in respect of the subject matter of the petition.

Keeping all issues on merits open, writ petition is disposed of.
