This Notice of Motion seeks an order against the Court Receiver to take possession of two flats, namely, flat Nos.203 and 204, described in prayer clause (a), from the Defendants who are currently appointed as agent of the Court Receiver in respect of the flats. In view of the order passed by this Court in the companion Notice of Motion, namely Notice of Motion No.2588 of 2010, the learned counsel for the Plaintiff does not press the present Notice of Motion. The Plaintiff has already been granted liberty to apply for further reliefs, after the Receiver submits his report, in terms of the order passed in Notice of Motion No.2588 of 2010. The Plaintiff will naturally have liberty to apply for the reliefs claimed in this Notice of Motion, in terms of that order. The Notice of Motion is disposed of accordingly as not pressed.
