The learned Counsel for the Plaintiff submits that the suit is settled as between the Plaintiff and Defendant Nos.7 to 9. Defendant Nos.7 to 9 have, accordingly, transferred their right, title and interest in the suit property to the Plaintiff.

2 It is submitted by the learned Counsel for the Plaintiff that during the pendency of the Notice of Motion, the Plaintiff has learnt that one M/s Sumer Corporation claimed to be the transferee of the suit property under a purported registered deed of conveyance dated 19 March 2008. The Plaintiff has, accordingly, taken out Chamber Summons No.1269 of 2012 for impleadment of M/s Sumer Corporation and two others. The learned Counsel for the Plaintiff submits that the Plaintiff, in the premises, desires to withdraw the present Notice of Motion with a liberty to take out a fresh Notice of Motion after M/s Sumer Corporation and others are joined as party Defendants to the suit.

4 Accordingly, the Notice of Motion is dismissed as withdrawn with liberty as prayed.
