P.C. :
1.An affidavit has been filed by the applicant, one Surjit Singh Sokhi. The
affidavit is dated 30th January 2014. Prima facie, it establishes that the
applicant is the only surviving legal heir of his parents. The applicant's father
carried on business in the premises in question, viz., Room No.5A, Vali
Mohamed Building, 165A, Dadasaheb Phalke Road, Dadar, Mumbai – 400 014.
Learned advocate for the defendants has no objection to the transfer of tenancy
as requested in the name of the applicant.
2. In view thereof, in response to the first prayer in the Court Receiver’s

report dated 20th January 2013, the Court Receuver is directed to permit the
transfer of tenancy in respect of this tenement in the name of the applicant.
Needless to add this transfer of tenancy will be subject to the compliance of all
statutory and legal requirements.
3.As regards prayer (b) of the report, the Court Receiver is directed to
prepare a new report with full particulars, including the balance available in his
hands, as also the demands raised by the Bombay Municipal Corporation. This
fresh report shall be made on or before 10th March 2014.
3. The Court Receiver's Report is disposed of accordingly.
