6] We have considered the submissions. As of today, the proceedings before the Caste Scrutiny Committee have not been disposed of. If the entry relied upon by the Applicant is genuine and if the relationship between the Applicant and Mahadu is established, the consideration of the said document for determination of caste claim will be relevant. The Applicant has given an undertaking not to come out with any other document or documents. It is true that such a prayer was not made in the Writ Petition when the Writ Petition was disposed of. It appears that the document became available to the Applicant subsequently. As of today, the proceeding before the Caste Scrutiny Committee is still pending. Therefore, in the interests of justice, an opportunity deserves to be granted to the Applicant to produce the certified copy of the said document. The result of allowing of the production of document will be some delay in disposal of the proceedings inasmuch as a Vigilance Cell Enquiry will have to be ordered on the basis of said document and even an opportunity will have to be granted to the Respondent No.4 to deal with the said document. The prejudice which may be suffered by the 4th Respondent can be compensated by directing the Applicant to pay costs quantified at Rs.25,000/-.
