Heard learned Counsel for the parties.
This is an application preferred by original
claimants for withdrawal of amount of Rs.1,21,000/-.
The learned counsel for the applicants submit that
first appeal preferred by respondent State of
Maharashtra was disposed of by this court by oral
judgment dated 26.09.2013. He submits that
respondentStateofMaharashtradeposited
compensation amount in this Court. Hence he may be
permitted to withdraw sum of Rs.1,21,000/- from the
said amount.

The learned A.G.P. appearing on behalf of
respondent/original appellant states that they have
no objection if civil application is allowed in
terms of prayer clause “B” only.
The learned counsel for the applicants
state that applicants are not pressing the civil
application in terms of prayer clause “C”. The
statement is accepted.
Considering the submissions made by learned
counsel for applicants and no objection given by
learned A.G.P. for respondent, civil application is
allowed in terms of prayer clause “B” which reads
thus :
“ The applicants may be allowed to withdraw the amount of Rs.1,21,000/deposited by the respondent no.1/ appellant vide D.D.No.771358 on 17.10.2013 in this Hon'ble Court. ”
