This Application is moved for bail. Earlier, Bail Application no. 527

of 2012 was withdrawn with a liberty to file fresh Bail application after 6 months.

2. The learned counsel for the applicant/accused submitted that today

only 6 witnesses are examined and prosecution intends to examine in all 17 witnesses. He submitted that the trial is going in a very tardy manner and, therefore, he has submitted this Application for regular bail, which is to be heard on merits.

Learned APP opposed the bail Application. She submitted that now

the matter is at the fag end of the trial. In all there are 17 witnesses. She

further submitted that the applicant/accused is a prime accused who is facing charge under section 302 of IPC and was caught red handed with knife.

In view of this submissions and previous record, instead of going on the merits of the matter, when the case has travelled half, the learned trial Judge to take up the matter day-to-day. Registrar (Judicial-I) has submitted a report dated 5^th September, 2014 informing the status of the trial. The report discloses that last witness was examined on 14^th March, 2014 and the next date is given on 20^th September, 2014. It is necessary for the learned Sessions Judge to keep in mind that there should not be such a long adjournment in the Sessions trial. The learned Sessions Judge to conduct the trial on day-to-day basis and may endeavour to complete the trial before 14^th September, 2014 and submit the progress report on 30^th September, 2014.
