time also certain security documents were required to have been produced. At both the stages i.e. at the stage of making a proposal and also at the stage of disbursement, fictitious documents were produced and various officers acted in malafide manner thus causing loss in Crores of rupees to the complainant bank. So far as the present applicant is concerned, earlier when his bail application was argued there were no arguments on the merits of the matter as to the case against him regarding submitting documents which were apparently forged and fabricated. However, the argument was only on the aspect that the applicant can be in a position to secure the amounts which were given to the individual members and the said amounts can be returned back to the complainant bank. That time it was argued that before the Co-operative Court various awards were passed against the individual members and the said amount comes to Rs.2.18 Crores and as such that is a secured amount. Moreover that time it was offered that the immovable property worth more than Rs.8 Crores and odd of the present applicant is available for disposal and sale and the said amount can be returned back to the complainant bank.
