agreed that the Petitioner and the Respondent Society shall refer their disputes if any to arbitration. Admittedly, the Petitioner and the Respondent Society were the only parties to the arbitration agreement as well as to the arbitration proceedings. After the passing of the Arbitration Award on 19th March, 2013, the members of the Society have by majority passed certain resolutions qua the redevelopment of the property of the society and the Society has thereafter implemented the Resolution by entering into a Registered Agreement dated 14-11-2013, granting development rights to the nominee of the Petitioner. The Society has also executed a Power of Attorney in this regard. The issues sought to be raised by the three members of the Society also includes the resolution/s passed by the Society and the agreements entered into thereafter, with the Petitioner and/or their nominee, which Resolution/s Agreement is in force and are not even challenged before the appropriate Court. None of the issues raised by the three members can be gone into by this Court in a Petition filed under Section 9 of the Act. However, the three members of the society who are Applicants to the above Chamber Summons shall be free to take out appropriate proceedings impugning the action of the Respondent and its majority members before the appropriate forum. Hence, I pass the following order :
