Heard learned counsel for the applicant and also heard learned APP for the State. This is an application for bail/suspension of sentence during the pendency of the appeal preferred by the appellant-original accused No.1. He was convicted for the offence punishable under section 397 of IPC and was sentenced to suffer imprisonment for ten years. He was also convicted for the offence under section 120B of IPC and was sentenced

to suffer imprisonment for ten years. For other offences minor imprisonments were imposed. He was also convicted for the offence under section 25 of the Arms Act.

Present applicant No.1 along with accused Nos. 2 and 3 was caught red handed on the spot outside the premises of the company where

total eight accused persons including the present applicant entered the premises of the Company armed with deadly weapons like pistole and choppers. They looted the said company and took away the gold ornaments. When the alarm was raised by the people and when the police gathered outside the premises where the dacoity was committed, these miscreants opened the fire on the police and started running away from the spot. In that process present applicant no.1 and other two co-accused were apprehended at some distance. From the black sack of the present applicant gold ornaments worth Rs.1,16,00,000/- crores were found which were seized.

Apart from the above case prima facie established against the applicant by way of conviction there is another criminal antecedent against the present applicant for committing the offence of similar nature and apparently he was on bail and he committed the present offence. All these circumstances weigh much with this Court for not allowing the present application for suspension of sentence. Hence, present application for bail is dismissed and accordingly disposed of.
