This application has been sent by the applicant, who is appellant in Criminal Appeal No. 425 of 2013, from jail. We had accordingly appointed Advocate Mrs. Farhana Shah, learned counsel to represent the applicant in this application. The applicant prays that necessary treatment be provided to him in the private hospital because the

jail authorities have failed in providing the necessary treatment.

We had called for the report from the jail authorities as well as the report from the Medical Officer of the Sassoon Hospital. The reports indicate that no immediate surgical intervention is required. The applicant complains of pain in both the knee joints. He was examined and accordingly an opinion is expressed that no surgical intervention is required. Medicines have been prescribed to be given to the applicant.

We, therefore, dismiss this application with a direction to the jail authorities to refer the patient to Sassoon Hospital if the applicant complains of any ailment and the referral is advised by the Medical Officer attached to the jail hospital.

Application is accordingly dismissed with the aforesaid

directions.
