had left their house for defecating. When she was proceeding, accused no. 1 came from behind along with the friend and had gagged her mouth from behind. He had asked accused no. 2 to catch hold of her. Both of them had threatened her of dire consequences in the eventuality that she has raised any cry or had informed anything to anybody. They took her into the bushes and she was ravished by accused no. 1. At that time, accused no. 2 was standing at a distance. In the said course, her glass bangle had broken and she had sustained injury to her hand. She has further stated since she did not reach home, her uncle and aunt had come out looking for her. At that time, accused no. 1 had raised cry alarming the other accused that the maternal uncle has come and therefore they both had fled. However, her uncle had apprehended them. There was a quarrel between the accused and her uncle and aunt on one side. Upon inquiry, she had disclosed the incident to them and then her uncle had brought her to the police station and report was lodged. On the basis of the said report, crime no. 45 of 2009 was registered at the police station for offences punishable under sections 376, 506, 109 r/w 34 of Indian Penal Code.
