ORDER
(ii) The conviction and sentence of the appellant for offence punishable under Sections 376 of the Indian Penal Code passed by the Additional Sessions Judge, Pune vide Judgment and Order dated 27th August, 1993 is quashed and set aside.
(iii) The appellant herein is acquitted of the charge under Section 376 of the Indian Penal Code.

(v) The fine amount if paid be refunded to him.
(vi) Writ be issued accordingly.
