The Application is moved for interim protection, as the matter is fixed before the Sessions Court on 5^th July, 2014 and interim protection is not granted by the learned Sessions Judge in between 1^st July, 2014 to 5^th July, 2014 .

Perused the FIR. The offence is registered under sections 195A, 452, 504, 506 and also under section 3 of the Scheduled Castes and Scheduled Tribes Act, 1989. On perusal of the record, it is found that the complainant and accused persons are hostile against each other. It is argued before this Court that the complainant is not a witness in CBI case No. 32/2011. However, he is directed to make such statement on affidavit before the learned Additional Sessions Judge, Pune on 5^th July,

2014, as the accused entering in the house and threatening is shown by the complainant that he is cited as a witness in the said CBI case. The Investigating officer to specify the sub-section of Section 3 of Scheduled Castes and Scheduled Tribes Act under which this offence falls. Hence, interim protection is granted to the applicant only upto 5^th July, 2014 on the following terms and conditions:

(i) In the event of arrest, the applicants shall be released on bail on furnishing P.R. Bond of Rs.20,000/- each with one or two sureties in the like amount.

(ii) The applicants shall appear before the police on 4^th July, 2014 between 1 p.m. to 2 p.m.

(iii) The learned Sessions Judge to decide the matter on merits.

The Application stands disposed of.
