03.11.2014, adinterim prearrest bail has been granted in favour of the Applicant in connection with Crime No.81 of 2014 registered with Hupari Police Station, Ichalkaranji, for offences under sections 380 and 381 of the I.P.C. In response to notice of the Application served upon the prosecution, learned APP has filed say. Perusal of the say as well as perusal of the papers of investigation do not reveal any other material collected during the course of investigation supporting the claim of the first informant of the relevant day of having given key to the Applicant and then the Mutation Book being kept in the cupboard. After taking into consideration such set of material against the Applicant even after passage of a period of three months, it is difficult to negative the prayer

for prearrest bail. Even appreciating the case of the first informant and taking into consideration that such event had unexpectedly occurred on the said day the claim against the Applicant of having stolen the said book clearly appears to be out of tune of the probability factor. It appears accordingly as the need of custodial interrogation of the Applicant, who is a public servant, cannot be upheld on the allegations, which are supported by no other material.
