3 It is the case of the prosecution that on 17th August, 2013 one Sandip Shivaji Hutagi lodged a report at the police station alleging therein that he was introduced to one Datta Kokane through a common acquaintance. That Datta Kokane was working as a professor in Bhavans College, Girgaon, Mumbai. Datta Kokane had informed him that he is an agent of a company which would give double the return within 6 months of investment. He was also informed that Shri Macchindra Karatmal who had introduced the complainant with Datta Kokane had also invested the money in the same. In the year 2010, the complainant had entrusted Rs. 3 Lakhs with Shri Datta Kokane. He had informed the complainant that he has invested the said amount in Shree Kuber Bhandar Tours and Travels Company and that he had retained the receipt of the said payment. After 6 to 7 months, the complainant had demanded the amount. At that time, he was informed that the company has closed down. However, he would return the amount within 2 to 3 months. Thereafter also he did not return the amount and therefore, the complainant was constrained to go and meet him in Bhavans college.
