. The only grievance of the petitioner in this petition is that though an advertisement has been issued by the Corporation for the appointment of Safai Kamgar and number of applications have been received by the Corporation, and is not considering the applications of the petitioners and not taking any further steps on the advertisement. Learned counsel for the Respondents submits that in view of the final order passed by the Industrial Court in Complaint (ULP) No. 162 of 2005, Corporation is constrained not to take any further steps on the advertisement. It is, however, submitted that they had challenged said order and the petition is pending in this Court. In our view, since the only grievance of the petitioner in this petition is that if any steps are taken by the Corporation in respect of the

advertisement, their representations should be taken into consideration and they should also be considered for being appointed on the said posts. In our view, it would be appropriate if the direction is given to the Corporation that in the event the order which is passed by the Industrial Court is set aside, they are directed to proceed on the basis of said advertisement to appoint vacant posts of Safai Kamgar, and in that event the Corporation shall take into consideration the applications made by the present petitioner, and accordingly take decision in respect of their appointment, in accordance with law. With these directions, petition is disposed of. Liberty is granted to apply, if necessary.
