Advocate Thakkar states that in obedience to the transfer order dated 23.6.2012, petitioner had earlier joined but his grievance along with the grievance of other employees has been looked into and in the Enquiry Report submitted by the Additional Chief Executive Officer it has been noted that the entire exercise of transfer was vitiated due to breach of the Government Policy. In this situation he submits that as regular transfers are due shortly, the case of the petitioner should be considered in the said process for appropriate posting.
The Assistant Government Pleader for respondents 1 and 2 states that he is still awaiting instructions.

Advocate Jachak for respondent no.3 submits that she is also awaiting instructions.
In this situation we find that interest of justice can be met with by permitting the petitioner to move appropriate representation pointing out the said enquiry report and expressing his choice for the regular/routine transfer to be effected in the month of May, 2013.
Accordingly, petitioner to make appropriate representation to the Chief Executive Officer/respondent no.3 within a period of ten days from today. If such representation is made, respondent no. 3 shall consider the same in accordance with law within a further period of three weeks during exercise of regular/routine transfer.
With liberty to petitioner to re-agitate his grievance, if cause of action accrues thereafter, the petition is disposed of. Certified Copy expedited.
