is directed to pay back wages and it is directed that the appellant therein is entitled for back wages, then suitable orders can be passed by the Education Officer regarding the payment of the same from the grants received. The petitioner/institution is receiving 100 % grants. The Education Officer would assist the Tribunal in arriving at proper conclusion. According to the learned counsel, the Full Bench of this Court in the case of St. Ulai High School, through its Principal & Anr. V/s Devendraprasad Jagannath Singh & Anr. reported in 2007 (1) Bom.C.R. - 540 has held that the Education Officer is necessary party in order to enable the Tribunal to adjudicate fully and finally on the dispute.

Education Officer, the same would not entail dismissal of Appeal. No relief is claimed against the Education Officer by the appellant.
