Ganesh Klchandrakant Choure Vs the State of Maharashtra and Ors.

Remedy of revision under section 154 (2A) of the Maharashtra Cooperative Societies Act, 1960 is available. However, this Court by an order dated 12^th of April 2012 directed the petitioner to deposit an amount of Rs.1,00,000/- within a period of four weeks from 12^th April 2012. The Court directed the respondents not to take coercive steps against the petitioner for recovery till next date of hearing.

Admittedly, the petitioner has not deposited Rs. 1,00,000/- till today. It is not in dispute that an amount of Rs.3,50,000/- was borrowed by the petitioner from the respondent-Bank. Contention of the petitioner appears to be that certain contentions/points have not been considered by the respondents-authorities. Contention is not that notice was not issued to the petitioner or mandate of relevant rules is not followed by the authorities while issuing certificate under section 101 of the Maharashtra Cooperative Societies Act.

Instead of entering into merits of the matter, the petition stands disposed of for non compliance of the order dated 12^th April 2012 with liberty to the petitioner to seek appropriate remedy as available under Maharashtra Cooperative Societies Act, 1960. It is clarified that this Court has not made any observations on merits of the matter.
