the orders passed. The present respondent had filed an appeal assailing the mutation entry 6856 certified on 21.10.2009. The appeal was filed on 11.02.2010. The respondent has stated that, when he received notice of caveat on 22.01.2010, he got the knowledge of said mutation entry. From the date of certification of the mutation entry, the appeal has been filed within a period of four month. In normal course the delay is of 90 to 95 days. The same is not abnormal one. Moreover, the respondent came with a specific case that on the date of receipt of caveat notice on 22.01.2010 he got the knowledge that the mutation entry has been certified. There is no contra evidence on record to show that the mutation entry certified was within his knowledge prior to 22.01.2010. The application for condonation of delay has been filed subsequent to the filing of appeal. It is not the case that the application for condonation of delay and appeal were decided together. The authority has first to consider the application for condonation of delay. The authority has dealt with the application for condonation of delay and till that time has not dealt with the appeal.
