The learned Counsel for the petitioner states that the petitioner did not wish to press the petition on merits and only desired to retain the possession of the premises for a period of 6 months and hence, a statement in that regard was made before this Court on 12.4.2013. This Court directed the petitioner to serve a copy of the petition on the respondent and also to file an undertaking that he would vacate the tenanted premises within a period of 6 months from 12.4.2013. The petitioner has filed an undertaking to that effect in this Court.
Hence, though the learned Counsel for the respondent raises an objection to the relief sought by the petitioner, the petitioner is permitted to retain the possession of the premises for a period of 6 months from 12.4.2013.

Hence, though the writ petition is disposed of as withdrawn, the petitioner is granted permission to retain the possession of the premises for a period of 6 months from 12.4.2013.
Learned Counsel for the petitioner states that the petitioner would deposit the arrears of rent in the executing Court within a period of one month and would continue to deposit the monthly rent in the executing Court till the possession is delivered on or before the expiry of the period of 6 months from 12.4.2013.
The statement made on behalf of the petitioner is accepted. Order accordingly. No order as to costs.
