would withdraw the additional affidavit of examination in chief dated 20-12-2012 and file a fresh affidavit of examination in chief by 16^th April 2013, which is the next date of hearing for the Suit in question. The Learned Senior Counsel appearing on behalf of the original Plaintiffs i.e. the Respondent Nos.1 and 2 has no objection to the said course of action being followed. The rejection of the said affidavit is on the ground that the same contains legal submissions. In view of the course of action which is now to be followed, there is no warrant to consider the impugned order on merits. With the direction that the Petitioners herein would file a fresh affidavit of examination in chief confined to facts on 16-4-2013, the above Petition is disposed of.
