The learned Counsel for the petitioner on instructions from the petitioner, who is present in the Court today, states that the petitioner is ready to withdraw the writ petition and would withdraw the same. The learned Counsel states that the petitioner should be however granted some reasonable time to vacate the premises.

The learned Counsel for the respondent no.4 fairly states that the petitioner may be granted some time to vacate the premises, as he is withdrawing the writ petition, but that should be subject to the condition that the petitioner furnishes an undertaking in this Court within a period of ten days that he would vacate the suit premises on or before 31.10.2013 and

would also deposit a sum of Rs.1,800/- every month in the executing Court on or before 5^th of the month.

The request made on behalf of the petitioner as well as the respondent is just and reasonable.

Hence, the petitioner is permitted to withdraw the writ petition. The writ petition is disposed of as withdrawn. The petitioner is, however, permitted to retain the suit premises till 31.10.2013, subject to the condition that the petitioner furnishes an undertaking in this Court within a period of ten days that he would positively vacate the suit premises on or before 31.10.2013 and would deposit a sum of Rs.1,800/- (Rupees One Thousand Eight Hundred Only) before the executing Court on or before the 5^th of every month during the six months. Order accordingly. No order as to costs.
