1 Heard.
2 By this petition, the petitioner prays that the proceedings pending against him in the Metropolitan Magistrate, 29th Court at Dadar, be quashed. The ground on which such a prayer is made, is that the police report and the accompanying documents do not make out any case against the petitioner.
3 Admittedly, no charge has been framed in the matter. The statutory remedy of applying for discharge by making an appropriate application before the learned Magistrate, is available to the petitioner.

4 When this aspect of the matter is discussed, the learned counsel for the petitioner seeks permission to withdraw the petition, and submits, that he would make an appropriate application before the learned Magistrate.
5 The Petition is allowed to be withdrawn and stands dismissed as such.
