Shri. Sopan Baburao Dham Vs Shri. Subhash Rambhau Dham and Ors.

By this Review Petition, the petitioner seeks review of the order dated 18/01/2013. By that order, the writ petition instituted by petitioner was dismissed.

In support of this petition, Mr.R.S.Kadam invited my attention to para 4 of the order dated 18/01/2013 as also, he invited my attention to the application at Exhibit 226 made by the petitioner on 12/10/2012 for issuing witness summons to the Branch Manager of Pune District Co-operative Agricultural and Rural Multipurpose Development Bank Limited, Branch- Saswad, (in short 'Bank'). He further submitted that the petitioner has already produced letters

issued by the Bank on record and in order to prove the contents thereof, the application Exhibit 226 was made.

I have considered the submissions made by Mr.Kadam. In para 4, there is typographical error in sentence in para 4 which requires to be corrected. The said sentence reads as under:

“It is open to the petitioner to produce letters before trial Court and prove the contents thereof.”

“ Since the petitioner has already produced the letters before trial Court, it will be for the petitioner to prove the contents thereof.”

Subject to this, no case is made out for reviewing the order. The order dated 18/01/2013 stands corrected to the above effect.
