P.C. :

The plaintiff has issued letters of credit through defendant No.1 bank for supply of goods to the plaintiff. The payment has to be made in Hongkong to defendant No.2 bank.

The plaintiff's bankers are stated to have received the documents upon which the payment is to be made by the plaintiff through its bank to defendant No.2 bank in Hongkong.

The debtor has to seek his creditor. The place where the payment is to be made is the material part of the cause of action.

In fact since the only payment is to be made under the letter of credit which has to be received by defendant No.2 in Hongkong, no part of the cause of action arisen here.

Leave under Clause XII of Letters of Patent cannot be granted and is refused.
