By the consent of the parties, order passed by this court on 8th May, 2009 ( Coram : Dr D.Y. Chandrachud, J.) is modified. The Chamber Summons is made absolute in terms of prayer clauses (a) (b) and (d).
(2) The petitioner - Mayur Girish Shah who is present in the court states that the name of the applicant would be added to the heirship certificate in all respect. He further states that Mrs. Kalpana Shah, mother of the Petitioner would be paid her legitimate share in the estate including the sum of Rs.80,865/- which is deposited in the Court in the name of the deceased mother and also pension amount exclusively. Statement is accepted. The Chamber Summons is made absolute in aforesaid terms. No order as to the costs.

(3) The Office is directed to release the amount in favour of the applicant on the basis of the authenticate copy issued by Associate of this court. The petitioner will assist the applicant in getting the amount released expeditiously.
