“pending admission” . In the company application, the petitioner has filed an affidavit dated 2nd September, 2013, stating that pursuant to the advertisement of the petition, no claims have been received by the petitioner. No claims have been lodged with the official liquidator also since the petition itself has not been notified by the official liquidator. The company petition was restored to the position of pending admission as the respondent had made out sufficient cause for not remaining present at the time of admission as well as final disposal of the company petition.
3 When the petition is taken up for admission, the learned counsel for the petitioner as well as the respondent state that the parties have entered into an amicable settlement. The learned for the petitioner states that a demand draft of Rs. 3,75,000 dated 03.09.2013 is handed over by the respondent in the court today. In view thereof, the petitioner seeks leave to withdraw the petition.
4 The company petition is accordingly disposed of as
withdrawn.
