On 28 February 2013, the submission of the learned counsel for the respondent that Notice of Motion for setting aside exparte decree upon which the present Company Petition is based is on board was noted and the matter was adjourned. The learned counsel for the respondent states that the exparte decree has now been set aside and the Summary Suit is now restored to file. The learned counsel for the petitioner states that in these circumstances Company petition at present does not survive. He seeks leave to withdraw this Company Petition. The Company petition is disposed of as withdrawn.

respondent will be refunded to the respondent after a period of two weeks from today. It will be open to the petitioner to seek appropriate orders in the Summary suit in that regard, failing which after period of two weeks the respondent will be entitled to withdraw the amount.
