Mr Desai invited my attention to the application dated 27.11.2012 at Exh. CA-1 made by (1) Shri Sanjay Bbabgoda Patil (respondent no.2 herein); (2) Shri Amol Ashok Lad and (3) Shri Pradip Balkrushna Aadsul made under Order 1 Rule 10 of the Code of Civil Procedure, 1908 for impleading them as respondents in Complaint (ULP) No.245 of 2012. The said application was allowed by the impugned order dated 21.1.2013 passed by the learned Member, Industrial Court, Maharashtra,

Kolhapur below Exhibits UA-1 and CA-1. The main petition was disposed of on 12.2.2013. He submitted that inadvertently S/Shri Amol Ashok Lad and Pradip Balkrushna Aadsul were not impeladed as respondents in the main petition. He, therefore, submits that the present application is taken out for impelading them as party respondents.

For the reasons stated in the application, the Civil Application is allowed in terms of prayer clauses (a) and (b) with no order as to costs. The applicants are permitted to add Shri Amol Ashok Lad and Shri Pradip Balkrushna Adasul as respondent nos. 4 and 5 in Writ Petition (ST) No.4439 of 2013. Amendment shall be carried out within two weeks from today. The Civil Application is disposed of.
