This is an application for condoning the delay of 240 days caused in filing the present application as also for bringing the legal heirs of the respondent No.1, since deceased, or record.

Mr. Karandikar submitted that during the pendency of the Appeal, sole respondent died and his advocate did not intimate about the death of the respondent. It is submitted that respondent died on 02.02.2012 and the applicant could not contact his advocate informing about the death of the respondent. The Second Appeal was admitted on 29.06.2005 and Mr. Sabnis had entered appearance on behalf of the respondent on 09.03.2007.

It is evident that the learned Counsel for the respondent has not intimated about the death of the respondent on 02.02.2012. In view thereof, in my opinion, the applicant has made out sufficient cause for condoning

the delay. Civil Application is allowed in terms of prayer clauses (a) and (b) with no order as to costs. The applicant shall carry out the consequential amendment in the appeal within two weeks from today.
