[2] This Civil Application is filed to condone the delay of 111
days caused in filing aforesaid Second Appeal. Mr. Talkute, learned
counsel appearing on behalf of the applicants in presence of applicant
Nos. 2 and 3 states across the bar that he has received letter dated 22nd
January, 2013 instructing him to withdraw the Civil Application as
parties have settled the dispute. The original letter purported to be

signed by six applicants is tendered before the court. Same is taken on record. Applicant Nos. 2 and 3, who are present before the Court confirm that all six applicants have signed letter dated 22nd January, 2011 and they wanted to put an end the litigation by withdrawing this Second Appeal. Said letter is taken on record. On the basis of request made by Mr. Talkute, Civil Application is allowed to be withdrawn with no order as to cost. In view of this, there is no need go ahead so far as C.A. and Second Appeal (St.) are concerned. Same are disposed of accordingly with no order as to costs. Papers be consigned to the record.
