Heard Shri Kedar, learned counsel for the applicant – petitioner, Shri Agrawal, learned counsel for respondents No. 1 & 2 and Shri Ambatkar, learned counsel for respondents No. 4 & 5.

The prayer is to condone delay of 14 days in filing First Appeal under Section 173 of Motor Vehicles Act, 1988. The orders of this Court on CAF No. 850 of 2012 are already complied with.

Shri Agrawal, learned counsel for respondents No. 1 & 2 and Shri Ambatkar, learned counsel for respondents No. 4 & 5 are opposing the prayer for condonation of delay.

We have perused the application. The application is supported by appropriate affidavit and we do not find any malafides on the part of the application which is MSRTC. Moreover, First Appeal has been filed by respondents No. 1 & 2 claimants on 31.01.2012 and the same has also been admitted on 10.04.2012, hence,

delay is condoned. The office to register First Appeal.

As orders passed on CAF No. 850 of 2012 are complied with, without prejudice to the rights of the respondents to apply for withdrawal, we allow the said application.
