ORDER

1.For the reasons contained in the civil

application and considering the fact that the
petitioner did not receive payment since 5.4.2011,
the amount of Rs.1,69,530/- deposited in this
court by respondents no. 3 and 4 under the orders
of this court is allowed to be withdrawn by the
applicant-petitioner. The office is directed to
pay to the applicant-petitioner aforesaid amount
through a demand draft.

2.The aforesaid amount was required to be
deposited in the court due to failure of the
management to lodge proper claim and smoothen the
payment to the petitioner. However, applicant had
not been paid said amount which entailed filing of
present application. We, therefore, impose cost of
Rs.10,000/- on respondents no. 3 and 4 to be paid
to the applicant-petitioner within four weeks from
today, through demand draft.

3.However, it would be open for respondents no.
3 and 4 to make claim for the amount of

subsistence allowance from the government, if
permissible in law.
