The Applicant is Original Accused No.14 in a Criminal Case arising out of C.R. No.246 of 2009 registered at Versova Police Station, Mumbai. The offence punishable is under Sections 364 and 302 read with Section 34 of the Indian Penal Code.

It is also common ground that the Sessions Case arising out of this C.R., being Sessions Case No.317 of 2010, has progressed to such an extent that the recording of evidence is complete and, equally, the oral arguments. In fact, the Judgment is being delivered.

To my mind, the only request made is that the Applicant's daughter is getting married on 27^th April, 2013 at 3:00 p.m., in the afternoon, at Navi Mumbai and the Applicant wants to attend the said marriage. He does not mind bearing the costs of the Police Escort, but he should be allowed to spend some time with his daughter and son-in-law, as he is ailing and on bed permanently.

Having heard the learned Counsel appearing for the Applicant and the learned A.P.P. for the Respondent-State, I am of the opinion that in order to enable the Applicant to attend the marriage of his daughter, which is going to be solemnized on 27^th April, 2013 at 3:00 p.m., interest of justice would be served, if the following order is passed :-

“O R D E R”

(i) The Applicant shall be permitted to attend the marriage of his daughter scheduled on 27^th April, 2013 at 3:00 p.m. at Navi Mumbai.

(ii) For enabling him to attend that marriage and prior ceremony and including the ceremony following the marriage, the Applicant shall be taken under Police Escort, who shall wear plain dress, on 26^th April, 2013 in the evening at about 5:30 p.m. and brought back in Police custody on 28^th April, 2013 in the evening at about 4:00 p.m.

(iii) The Applicant shall bear all costs, charges and expenses of he being taken out of the Prison and for the marriage ceremony of his daughter under Police Escort. For the present, the Applicant shall deposit a sum of Rs.25,000/-, approximately, in the Trial Court.

The Criminal Bail Application is disposed of in the above terms.
