In the presence of the applicant's brother, Mr.Marwadi, learned Counsel appearing on behalf of the applicant seeks leave to withdraw this application. Leave granted. Application is dismissed as withdrawn.
2 Since it is stated that the applicant has been in custody for an offence punishable under Sections 302, 201, 120B read with 34 of IPC in connection with the CR No.109/2012 registered at Malwani Police Station, the learned Judge to whom the Sessions case has been assigned, would be well advised to dispose it of expeditiously. The applicant is stated to have been arrested on 4th May, 2012. For all these reasons, the Sessions case be disposed of expeditiously and by 31st December, 2013.
