Heard the learned counsel for the applicant and the
learned APP for the State. With their assistance, I have glanced through the relevant parts of the charge-sheet. 2 There exists a strong prima facie case against the applicant. It also appears that, the applicant was not available to the investigating agency for quite some time after the

registration of the crime. That no gain has been made by committing the alleged offences, cannot be accepted. Simply because the co-accused has been released on bail, I do not think it proper to release the applicant on bail, particularly when he appears to be involved in at least two other cases of similar offences. Additionally I am informed that he is also accused of having committed an offence punishable u/s 376 of the IPC.
