Heard learned counsel for the applicant Smt. Pratibha wd/o Manoj Verma who is present with him.

The counsel for the applicants/petitioners has filed pursis showing information about the present position of the deposits which were ordered to be made by this court in the judgment and order dated 21.10.2005 in Criminal Writ Petition No.99/2005. It appears that the entire amount that was deposited in the name of Smt. Pratibha wd/o Manoj Verma was withdrawn and therefore her MIS account has been closed in the post office. In so far as the two accounts are concerned i.e. in the name of Ku. Sneha and Ku. Riya both daughters of Manoj Verma – the deceased, amount of Rs. 2,00,000/- each that was deposited in the MIS Scheme in General Post Office, Nagpur is lying without any interest after 20.11.2011 i.e. the date of maturity. The Registrar of this Court had made a request to the General Post Office to renew the said deposits

but the General Post Office, Nagpur, informed to the Registrar that Monthly Income Scheme cannot be renewed and therefore the said deposits cannot be renewed. Unfortunately on both these accounts i.e. MIS A/c No. 18569 and MIS A/c No. 18570 interest from 20.11.2011 has thus been lost. This is because of the lack of knowledge of the applicant Smt. Pratibha wd/o Manoj Verma who did not inform the date of maturity to the Registrar of this Court. The interest as well as dividend on both these deposit accounts of Ku. Sneha and Ku. Riya is demanded by the applicant for expenses. The request is genuine and hence she should be allowed to withdraw interest and dividend accrued till the date of maturity for expenses for her daughters or for herself. She then submits that the principal amount of Rs.2,00,000/- of each account of Ku. Sneha and Ku. Riya should be reinvested in fixed deposits and she should be paid monthly interest on both these accounts. She further submits that State Bank of India, Vardhaman Nagar Branch is the nearest branch of nationalized bank where it would be convenient for her to visit.

In view of the above, we make the following

ORDER .

i) General Post Office, Nagpur is directed to make payment of interest and dividend accrued till the date of maturity i.e. 20.11.2011, if any, on the account of Ku. Sneha (MIS A/c No. 18569) and on the account of Ku. Riya (MIS A/c No. 18570), to Smt. Pratibha wd/o Manoj Verma by instrument within a period of 15 days of the date of service of this order, payable in her bank account.

ii) State Bank of India, Vardhaman Nagar Branch, Nagpur, shall open two accounts in the name of Ku. Sneha d/o Manoj Verma and Ku. Riya d/o Manoj Verma and the Branch Manager of State Bank of India, Vardhaman Nagar Branch, Nagpur shall take care to make fixed deposit of these two amounts of Rs.2,00,000/- each in the best possible scheme which should yield monthly, quarterly or half yearly interest for the survival of the family on these two accounts and for such period as the Branch Manager finds the best and thereafter to continue to reinvest unless otherwise sought by the applicant by approaching this court.

Let the order be carried out by the concerned authorities.

All other applications are disposed of as infrutcuous.
