Rupesh Omprakash Tiwari and Ors. Vs the State of Maharashtra

The case against the accused is essentially for outraging the modesty of the complainant by abusing her in filthy language and forcibly taking her out of a taxi in the early hours of the morning in a public place. The complaint is that during the scuffle the mangalsutra of the complainant was misplaced when she had to flee with the accused following him until one person came to save her. The corroborative evidence of that person shows the accused beating the complainant and the complainant shouting when he went to rescue her. However the prosecution case which was also of causing hurt has not been established by the evidence. The only evidence is under Section 354 of the Indian Penal Code which would have to be considered

in the Revision Application.

The accused is released on same bail as granted in the trial Court pending the Criminal Revision Application with the same conditions.
