1 Heard Mr.Niranjan Mundargi, the learned counsel for the applicant, and Ms.R.M.Gadhavi, the learned APP for the State. The report submitted by the Investigating Officer addressed to the Public Prosecutor, is tendered by the learned APP, and the same is taken on record. I have gone through the same.
2 It is clear that the applicant’s wife has a fixed place of residence, where she stays with her children and the mother of the applicant. The Magistrate shall, therefore, treat that the Condition no.

(iv) in the bail order dated 17.4.2013 has been complied with and deal with the surety application in accordance with law.
3 The applicant shall, however, report to the Parksite Police Station on every Saturday, instead of every alternate Saturday, as stipulated by the order dated 17.4.2013.
4 Further, the wife of the applicant shall file an undertaking in writing before the Magistrate that she shall not change her residence without prior intimation in writing to the Investigating Officer and / or the learned Magistrate.
5 The application is disposed of in the aforesaid terms.
