At the outset, learned counsel for the applicant

requests that the applicant may be permitted to withdraw this application as the applicant does not press for the relief

prayed for, in this application at this stage. Learned Counsel for the applicant further pointed out to us that the applicant had filed Criminal Application No.1253 of 2012 which was withdrawn by the applicant with the liberty being granted by the court for filing an application afresh in the event the appeal was not heard within six months. Since the appeal is not been decided, the applicant has preferred this application.

Learned Counsel for the applicant submits that the applicant is in jail since more than six years and therefore request that since the Court is already hearing Criminal Appeals of the year 2009, this Appeal be set down for final hearing as the paper book have been received.

We see no impediment whatsoever, in acceding to the request of the applicant and since the application is not pressed, we direct that the Appeal filed by the applicant alongwith other companion Appeals be added to the Final Hearing Board w.e.f. 5th August, 2013.
