The Learned Single Judge by the impugned order dated 16 July 2012 had directed a notice to issue why action for breach of an undertaking should not be initiated against the Appellant. Subsequently according to counsel appearing on behalf of the First and Second Respondents, the Contempt Petition was dismissed by an order dated 5 October 2012. In the circumstances, the Appeal has been rendered infructuous and is dismissed as such.
In view of the dismissal of the Appeal, Notice of Motion 2249 of 2012 does not survive and is disposed of as such.
