Ghongade was admitted in Civil Hospital Solapur by the villagers as he had sustained grievous injuries. The Medical Officer intimated the police about the medico legal case. P. S. I. Rajendra Vithoba then visited the hospital and recorded the statement of Avinash Ghongade. The said statement was recorded in the presence of the doctor. Avinash Ghongade disclosed to the police that on that day, he was in his agricultural land for the whole day and returned home at about 6.00 a.m.. The harvesting season of chillies was going on and he had to engage some lady labours for plucking the chillies and therefore had been to the village to engage the lady labours. He then had proceeded to engage a vehicle for transporting the chillies to Pune. He went to S. T. stand at about 7.30 p.m. He went to urinal to answer nature's call. Suddenly the accused persons mounted assault upon him. Both the accused are brothers interse. The accused no. 1 had given a blow of knife on his stomach and abused him in filthy language. He was about to give a second blow to him, at that juncture the complainant turned back. He was pinned to the ground by original accused no. 2 and thereafter accused no. 1 i.e. the present appellant gave blows of knife on his person. Hence he sustained injuries on his chest, right hand, waist, arms, thighs, buttocks etc. Thereafter the assailants had fled away.
