particularly evidence of the eye witnesses as well as the witnesses with regard to the extra judicial confession, cannot be relied upon in the light of their unnatural conduct and the fact that their statements were recorded nearly after three weeks of the incident. None of the witnesses had disclosed what they had seen or heard, though several opportunities were available to these witnesses. All these witnesses had maintained stoic silence and it is inexplicable as to why these prosecution witnesses did not choose to disclose the incident to the relatives of the deceased Govind Patil or to the police who were present in the village. The credibility of these witnesses, therefore, according to us, is affected and no reliance can be placed on the testimony of these witnesses, who had disclosed about the incident after nearly 15 days of the incident. We, therefore, find that there is absolutely no evidence for supporting the conviction of the appellant. The clothes alleged to have been discovered by the accused were discovered nearly three weeks of the incident. Moreover, there is no evidence regarding the sealing of the clothes immediately on their seizure. In the face of this evidence, therefore, according to us, no reliance can be placed on the report of the Chemical Analyzer in respect of finding of blood stains on the clothes of the appellant.
