The grievance of the Petitioner is that inspite of repeated requests made by the Petitioner to the Assistant Charity Commissioner, Sangli to expedite the hearing of change reports referred to in prayer clause 20(b) of this Petition, no orders are passed by the said Authority so far. The last such request was made by the Petitioner on 12^th September, 2012.

The Petitioner had approached this Court with similar grievance on the earlier occasion, by way of Writ Petition No. 2404/2012, which came to be disposed of by order dated 12^th April, 2012, giving liberty to the Petitioner to move the Assistant Charity Commissioner.

When the Petitioner has already invoked that option, it

is expected that the Charity Commissioner ought to have passed to pass order one way or the other, at least on the application preferred by the Petitioner for expeditious hearing of the said change report. Merely taking the request of the Petitioner on record cannot be countenanced.

We dispose of this Petition with a hope that at least Assistant Charity Commissioner would process the latest application made by the Petitioner on 12^th September, 2012 and proceed in the matter in accordance with law, expeditiously.

We have no manner of doubt that the Assistant Charity Commissioner would keep in mind the exposition of this Court in the case of Chembur Trombay Education Society and Ors. vs. D. K. Marathe and Ors.⁽¹⁾ and Jagatnarayansingh Swarupsingh Chithere and Ors. vs. Swarupsingh Education Society and Anr⁽²⁾ .
