1.Heard learned counsel appearing for the

respective parties.

2.The Petitioner seeks direction to the

Respondents to accept her examination form for Vth
Semester of BTech. The Petitioner had approached
the Authorities, one day late than the prescribed

time limit for submission of the form. According
to the learned counsel for the Petitioner, the

¶28

Petitioner was not keeping well and she was
suffering from viral fever, therefore, the delay
occurred in submitting the said form.

3.Shri. Tambe, learned counsel for

Respondents has placed on record, an affidavit in
reply filed on behalf of Respondent No.5. The
learned counsel submits that in view of the

Regulations applicable to the Agricultural
Universities for Bachelor's Degree course, the
Petitioner's request cannot be considered.
However, the learned counsel submits that on the
application filed by the Petitioner, her request
to appear for further Semester (VIth Semester),
could be considered, by the Authorities.

4.We have perused the relevant Regulations
placed on record and the affidavit in reply filed
on behalf of Respondent No.5. We are not convinced
to issue directions to the Respondents to accept
examination form of the Petitioner for for Vth
Semester of BTech. However, in case the
Petitioner desires to appear in the VIth Semester
of B. Tech., we direct the Respondent Authorities

to consider the request of the Petitioner
favourably and pass appropriate order on the same,
in accordance with the Rules and Regulations and
communicate the same to the Petitioner.

5.With these observations and directions,
