By way of this petition, the petitioner has challenged the decision taken by respondent no.2 rejecting the bid of the petitioner on the ground that there is a variance in her signature as appearing in the registration certificate and that appearing in tender document. The dispute is regarding not accepting the bid of the petitioner though, according to her, she was the lowest bidder.

Mr P D Kothari, the learned AGP, after taking instructions from the officer who is present in the Court, makes a statement that the entire work on the

basis of the tender is already completed. Since the entire tender work is already over except two items of work which are ordered to be cancelled, now no relief can be granted in favour of the petitioner inasmuch as the prayer made in the petition has become infructuous. Learned AGP, however, further makes a statement that in future if the petitioner takes part in tender process, the signature made by the petitioner in registration certificate shall be considered as authenticate signature. The statement is recorded.
